DMCA Copyright Policy

Maps Driving and Directions respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we have adopted the following policy toward copyright infringement. We will respond to notices of alleged copyright infringement that comply with the DMCA and other applicable laws.

Copyright Policy

Maps Driving and Directions respects the intellectual property rights of others. We prohibit users from uploading, posting, or otherwise transmitting on or through our services any materials that violate another party's intellectual property rights. When we receive proper notification of alleged copyright infringement, we will promptly remove or disable access to the allegedly infringing material and terminate the accounts of repeat infringers as described herein in accordance with the DMCA.

Reporting Copyright Infringement

If you believe that any content on Maps Driving and Directions infringes your copyright, you may submit a notification pursuant to the DMCA by providing our Copyright Agent with the following information in writing (see 17 U.S.C. § 512(c)(3) for further detail):

  1. Identification of the copyrighted work: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. Please provide a description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: Identification of the material that you claim is infringing or is the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Maps Driving and Directions to locate the material. Please provide the URL or other specific location on our website where the allegedly infringing material is located.
  3. Contact information: Information reasonably sufficient to permit Maps Driving and Directions to contact you, such as your name, address, telephone number, and email address.
  4. Good faith statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Signature: A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

DMCA Takedown Procedure

Upon receipt of a valid DMCA takedown notice, Maps Driving and Directions will:

  • Promptly remove or disable access to the allegedly infringing material
  • Notify the user who posted the material that it has been removed or disabled
  • Provide the user with a copy of the takedown notice
  • Inform the user of their right to submit a counter-notification

We will make a good faith effort to contact the user who provided the allegedly infringing content so that they may make a counter-notification pursuant to sections 512(g)(2) and (3) of the DMCA.

Counter-Notification Procedure

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Copyright Agent. To be effective, a counter-notification must be a written communication provided to our Copyright Agent that includes substantially the following (see 17 U.S.C. § 512(g)(3) for further detail):

  1. Identification: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  2. Good faith statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  3. Contact information: Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Maps Driving and Directions may be found, and that you will accept service of process from the person who provided notification of the alleged infringement or an agent of such person.
  4. Signature: Your physical or electronic signature.

Upon receipt of a valid counter-notification, Maps Driving and Directions will:

  • Promptly provide the person who submitted the original takedown notice with a copy of the counter-notification
  • Inform that person that Maps Driving and Directions will replace the removed material or cease disabling access to it within 10 business days
  • Replace the removed material and cease disabling access to it not less than 10, nor more than 14, business days following receipt of the counter-notification, unless our Copyright Agent first receives notice from the person who submitted the original takedown notice that such person has filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on our service

Repeat Infringers

It is the policy of Maps Driving and Directions to terminate, in appropriate circumstances, the accounts of users who are repeat infringers. A repeat infringer is a user who has been notified of infringing activity more than twice and/or has had infringing content removed from our services more than twice.

We may also, at our sole discretion, limit access to our services and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

False Claims

Please be aware that if you knowingly misrepresent that material or activity is infringing, you may be liable for damages, including costs and attorneys' fees, under Section 512(f) of the DMCA. We reserve the right to seek damages from any party that submits a notification of claimed infringement or counter-notification in violation of the law.

Maps Driving and Directions may contain links to third-party websites, services, or content that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third-party websites or services. If you believe that content on a third-party website linked from our services infringes your copyright, you should contact that third party directly.

Modifications to This Policy

Maps Driving and Directions reserves the right to modify this DMCA Policy at any time. We will notify users of any material changes by posting the updated policy on this page. Your continued use of our services after any changes constitutes your acceptance of the modified policy.
